DIGITAL TERMS OF SALE
Please read these Terms of Sale (these ‘Terms’) carefully before purchasing or using any Programs, Products, Courses, Meditations, Services, or Materials (‘our Products’) from Jo Cooper trading as Holistically Whole.
Our intention is that these Terms are fair, balanced and set out the intentions upon which we are working together.
1. General
1.1 These products are provided by Jo Cooper trading as Holistically Whole ("we," "us," or “Holistically Whole"). "You" refers to any purchaser or user of our Products.
1.2 By ordering from us at https://www.holistically-whole.co.uk or using any of our Products, you are agreeing to these Terms. If you disagree, please do not buy or use our Products.
1.3 We may update these Terms occasionally. Changes will be effective upon posting them on our site or via email.
2. Mutual trust and cooperation
2.1 It is important to us that this agreement between us is fair and reasonable and that we are both intentional about our energy, efforts and intentions.
2.2 Both parties agree to act in good faith and in the spirit of mutual trust and cooperation.
2.3 Both parties endeavour to engage and communicate openly, respectfully, fairly and in the spirit of mutual benefit.
3. Payment
3.1 In exchange for access to the Product(s) you agree to pay the full price stated at checkout.
3.2 If you choose a payment plan (if one is available), payments will be deducted from your chosen payment method. If you miss a payment, we will follow up with you. If you do not keep up with your payments, we may cancel your access to the Products and you will not be entitled to receive a refund for payments already made.
3.3 You are responsible for the full fee, even if you miss sessions (if any), change your mind, choose to cancel or choose not to use our Products.
3.4 If you are experiencing payment difficulties then please talk to us.
4. Returns and Refunds
4.1 Once you start downloading or accessing our Products, refunds and cancellations are not available because you have already gained the benefit of access to the materials.

5. Pricing
5.1 Prices are as stated on our site at the time of your order.
5.2 Prices may change from time to time and we may run promotions, but this won't affect your existing orders.
6. Intellectual Property and Use of Our Products
6.1 All materials within our Products are assets of Holistically Whole are valuable and should only be used for personal purposes. You receive a limited license to use our Products, which cannot be shared or resold.
6.2 Our products, materials and intellectual property remain our exclusive property.
6.3 You agree not to share, copy, adapt, reproduce, republish, translate, upload, post, distribute, create similar works or sell any part of our materials or misrepresent them as your own.
6.4 You must not use the materials or any of our Products in any unauthorised way or breach any of our intellectual property rights.
6.5 You must not use our materials in a way that can harm our reputation.
6.6 Breach of any of this clause 6 may lead to legal action.
7. No Guarantees
7.1 We do wholeheartedly believe that you will achieve results with our Products; however, you will understand that every individual is unique and results may vary.
7.2 Your success depends on various factors, including your commitment, openness and effort.
7.3 You will understand that for legal reasons:
7.3.1 We cannot 100% guarantee or represent that you or your business will have any success as a result of using our Products.
7.3.2 We provide no express or implied warranties or guarantees regarding the accuracy or effectiveness of our Products.
7.3.3 Testimonials are not guarantees of results and are not representing or guaranteeing that you will achieve the same or similar results.
7.4 You agree that we do not provide any medical, legal, investment, or financial advice. All opinions are provided for your consideration and should not be solely relied upon. It is your responsibility to obtain professional advice.
8. Health Considerations
8.1 Please avoid alcohol and non-prescription drugs at least 24 hours before and after sessions for best results.
8.2 You agree that we do not offer medical advice. We are not qualified medical practitioners and do not provide medical consultations or advice relating to medical, psychological, psychiatric or health conditions.
8.3 We do not diagnose or treat health conditions. Always consult your doctor about health concerns and ensure that the Products are suitable for you to use.
8.4 During your use of the Products you may be exposed to information or situations that trigger deep or otherwise unresolved emotional responses. By using and participating in our Products you are confirming that you are mentally and emotionally well enough to do so and that you understand that you are personally responsible for managing your own emotional state. However, if triggers do arise please contact us for support.
8.5 You agree not to hold us liable for any emotional distress experienced as a result of your participation in the Products.
9. Delivery of Products
9.1 Our Products may be delivered in pre-recorded sessions or through downloadable content. Please read the descriptions carefully before purchasing.
9.2 We strive for high-quality delivery but cannot guarantee uninterrupted access from time to time if, for example, the technology or third-party servers we use are undergoing maintenance or repairs. Whilst we shall use all endeavours to ensure this never happens, we shall not be liable in the event the content on third-party servers is deleted, fails or is no longer stored through no fault of our own.
10. Use of our Products and Platforms
10.1 Whilst using or participating in our Products you may:
10.1.1 post or submit material on or through our Products;
10.1.2 comment in or share information in support groups or chats inside online course portals, on social media or other chat based apps such as Voxer, Telegram or WhatsApp;
10.1.3 participate in calls with video and audio recordings;
10.1.4 share feedback or information which can be used as a testimonial; and
10.1.5 share or submit other materials of any kind.
10.2 You understand that your participation in our Products is your acknowledgment that any materials you post may be seen by other users / clients of our Products.
10.3 You consent to us using those materials (including posts, comments, photographs, audio, video, feedback, testimonials and so on) for marketing or promotional efforts.
10.4 You agree to respect the privacy of other users of our Products and agree not to share or repost any content outside of these spaces.
10.5 You must not use our Products or platforms as a way to self-promote, abuse or cause harm to others, or spam or solicit clients.
10.6 We are not responsible for any content provided by third parties and the inclusion or use of their services does not imply any endorsement or association.
11. Confidentiality
11.1 Confidential information refers to any data or information relating to you, whether business or personal:
11.1.1 which would reasonably be considered to be private or proprietary to you;
11.1.2 that is not generally known, and;
11.1.3 where the release of that confidential information could reasonably be expected to cause harm to you.
11.2 We respect your privacy and will not disclose your confidential information except as authorised by you or as required by law.
11.3 If there is something you explicitly do not want to disclose, please tell us.
12. Complaints
12.1 If you're unsatisfied, please contact us directly. We'll try to resolve your concerns fairly.
12.2 If the complaint is unresolved after 28 days, we both agree that all disputes will be mediated in good faith. We will agree a third-party mediator to help us settle the dispute. If we cannot agree a name within 14 days, we will apply to the Centre for Effective Dispute Resolution (CEDR) for the nomination of a suitable mediator.
12.3 We both agree to use our best endeavours to agree a solution in the mediation. If meditation does not settle the dispute, the parties agree to arbitrate the dispute. An application should be made to the Chartered Institute of Arbitrators for the nomination of an appropriate arbitrator.
13. Other and Governing Law
13.1 This document represents the entire agreement between us and supersedes any prior agreements.
13.2 If any of these terms are invalid, illegal, or unenforceable, it is to be deemed modified in order to comply with applicable law, and the remaining provisions shall not be affected in any way.
13.3 These Terms are governed by English law, and any disputes will be settled in English courts.
